Manslaughter….by the Supreme Court of the world’s biggest democracy..!

Isn’t it a court terrorism?

A must read to expose the genocide committed by the Indian Supreme Court in broad day light. These judges deserved to be tried for man slaughter.

An excellent must read article by NANDINI SUNDAR which appeared in The Hindustan Times of Lucknow dated 12 February 2013…………………………………………………..When Kashmiris say they don’t feel part of India, they are only reiterating a truth that Indian politicians and governments voice all the time. What else does it mean when politicians and large sections of the media talk of how happy ‘Indians’ are at the hanging of Afzal Guru, when his execution is touted as a cathartic closure for ‘India’.

The last time I checked, there was curfew in Kashmir and thousands of other justice-loving people were deeply unhappy at the secretive execution, and at the use of the death penalty to fulfil some atavistic blood lust. How else to read the judges’ pronouncement — even as they noted discrepancies in the police version of his guilt — that the hanging was required to satisfy the ‘collective conscience’? In fact, Durkheim’s phrase ‘collective consciousness’ conceals the manufacture of consent through the media, the courts and other institutions. And contrary to his prediction that in an interdependent and complex society we would see a growth in reparative justice, in India, what we see is the growth of a vulgar retributive justice, where primal passions are deliberately inflamed to create a divide between ‘us’ and ‘them’.

‘Us’ in the context of contemporary India means the Bajrang Dal who distributed sweets to celebrate the hanging and blackened the faces of people with opposite views; it means the rightwing goons who groped and sexually abused female protesters outside a Delhi college last week with full police connivance.

But ‘us’ also includes the cynical coterie of Congress politicians who periodically decide to join the BJP bandwagon for electoral purposes. If opening the locks of the Babri Masjid and legislating against the Shah Bano judgement were permanent blots on Rajiv Gandhi’s claim to be secular, his son’s installation in the formal pecking order of the Congress has been accompanied by the opportunistic hanging of Afzal Guru.

Sonia Gandhi may have pleaded against the death penalty for Rajiv’s killers, but unless her party takes a principled position against the death penalty for all, this will seem like the rest of her liberal outreach programme, designed to ensure her own good name.

‘Them’ includes all the ordinary people of India — who have had their lands forcibly acquired, their homes burnt, their relatives killed — in riots and pogroms. ‘Them’ are the seditious fisher folks of Kudankulam, the grave security threats who inhabit the mineral rich villages of Dantewada, the Naga elder and the Kashmiri woman.

And then there are some whose status as ‘us’ or ‘them’ depends on the political calculations of the day. Balwant Singh Rajoana, on death row for the assassination of former Punjab chief minister Beant Singh, may not be hanged because the Akali lobby is important to ‘us’. But clearly it is not important enough for the victims of 1984 to get justice, in which case they fall into the ‘them’ category.

We are told that the ‘Law’ has taken its course, the ‘Law has come full circle’. Where is this law when the widows of Delhi 1984 are still waiting for justice — and people like HKL Bhagat have died before they could be hung (not that this was ever a worry for him); when the murderers of Gujarat 2002 are still roaming free, and having the EU and others cosy up to their government? Did the law come full circle when the murderers of Bathani Tola were acquitted? Where was the law when thousands of mass graves were uncovered in Kashmir and thousands ‘disappeared’; where is this law when women are raped and their rapist officers or jawans get full protection under the Armed Forces (Special Powers) Act (AFSPA)?

Deponents at the Verma Commission provided a number of cases in Kashmir where the courts had prima facie indicted army personnel, but the central government refused to give permission to prosecute. The Upendra Commission clearly found that Thangjam Manorama was raped and murdered by personnel of the Assam Rifles in Manipur, but not one person has been punished. In Chhattisgarh, young bravehearts who filed rape cases against special police forces with great difficulty — resulting in arrest warrants against the accused — are being coerced to take their statements back. But then, I forgot, Kashmiris, Manipuris, the adivasis of central India — are not ‘us’, they are not ‘Indian’.

When asked why the AFSPA is needed to protect armed personnel — since rape can never be done in the line of duty — high-ranking officers come on television to say that 99% of the charges against the army are false, and the women are put up to it by Maoists and militants. So shall we assume then, that the women of the North-east, of Kashmir and adivasi India are congenital liars? Or that the law is designed to ensure they are fair game, a welcome pastime in the ‘course of duty’? Or perhaps, more simply, these women are not ‘Indians’.

If to be Indian is to accept the death penalty, if to be Indian is to accept the unjust hanging of a tortured man born of a tortured and alienated people, if to be Indian is to accept the rapes of my sisters and the impunity of its officers, let me say in the words of the Turkish poet, Nazim Hikmet, “Yes, I am a traitor, if you are a patriot, if you are a defender of our homeland, I am a traitor to my homeland; I am a traitor to my country… if patriotism is the claws of your village lords, … if patriotism is the police club, if your allocations and your salaries are patriotism,… if patriotism is not escaping from our stinking black-minded ignorance, then I am a traitor.”

Revenge of the Prime Minister

                              Revenge of Supreme Court’s Punishment?

Since the Supreme Court of Pakistan punished our beloved P.M. (elected with a two third majority of the parliament) for a few seconds, he seems to have decided to go on a revenge policy, to punish the entire 180 million people of Pakistan, with virtual cessation of electricity supplies, in this extremely hot season.

And, after putting the general public on hot burner, the worthy convicted P.M. has himself left on a sojourn, to watch the Queen opening the session of the UK parliament.

I will request with my folded hands, to the honourable judges of the SC, to kindly condone the punishment of our beloved P.M.,  so that in return, the general public of Pakistan is released by the government from the perpetual sentence, of being condemned to the hell. Otherwise, the general public will remain hostage, with this highly honest & efficient government.

Moreover, it looks the government is hell bent to prove  the U.S. Senator correct, that Pakistan is a failed state, under this highly competent government of PPP.

Mr. Chief Justice of Supreme Court of Pakistan – The Nation is Calling You Again

The fact is that panacea of Pakistan’s many ills lies in removing the out dated laws from the statue books of the country, where we have been made prisoners of our past.

Mr. CJ you and your honourable colleagues have done a lot for this country. Kindly do us another favour, for which our generations will be thankful to you.

Please find a solution to immediately replace the current election process (which is the mother of all problems) with a new one in which every party leader should stand to be elected directly, as head of the government. However, before the elections, each participating party will declare a list in advance of it’s assembly members (for the voters to know beforehand the qualifications, capabilities, character & mettle of their future public representatives). Now after the elections, the proportionate number of these advance named party representatives will be automatically elected, starting from the top of the list, according to the share of the votes polled in favour of the party leader.

In this way, very high quality members (who will be even confirming the appointment of judges) will come to assembly, Jagirdars hold on voters will lose its grip, election expenses will be drastically reduced, sale of votes will be eliminated, neat and corruption free governance will emerge, Biradari system menace will crack down, people’s frustration from the democracy will be minimized, parties will be forced to implement their manifesto and people’s say in direct selection of rulers will increase manifold.

Sir, the definition of insanity says “doing an act over and over again and expecting a different result.” There is also a saying in IT jargon that “Garbage in garbage out”. The existing system will never deliver in our circumstances. So, kindly help this nation come out of the clutches of the prevalent exploitive system, whereby, 3-5 % cruel minority is ruling & plundering rest of the suffering majority.

The change of system will also automatically stop the talk of dismemberment of Pakistan, so rampant these days.

Respected Sir,

 

Firstly, I will beg excuse for taking your valuable time, for inviting your kind attention, towards the subject matter. The moment I read a news on Friday, 08 April 2011 titled
“India to get Swiss bank info for cases dating from Jan 2011” on Times of India Website, my mind immediately went towards your honors’ pain staking efforts, in getting back all the looted money of Pakistan, from corrupt persons whether, in Pakistan or abroad.
 

Sir, although, getting rid country of corruption, is the duty of every Pakistani and more so of the ruling elite yet, the prevailing atmosphere is such, that whenever, there is a news on a corruption scandal, whether big or small, the general public only pins its hope towards the judiciary. In fact, the present judiciary under your ‘DYNAMITE’ leadership is the only and last hope for the survival of the Pakistani nationhood. However, there is no denying the fact, that this situation has unimaginably burdened the judiciary, beyond its resources. I firmly believe that our judiciary will not be tired down, by this enormous task lying before it. I am also of firm belief, that the battle of survival of Pakistan, will only be fought and won, in the superior courts and nowhere else.

 

Under the circumstances, if your honor deems it appropriate, it is earnestly requested that some kind of government to government protocol may be initiated by Pakistan, under the watchful eyes of the Supreme Court, with not only Switzerland but all other such countries & Islands, where our looted money is stashed by the corrupt people, whom I consider traitors, as well.

 

Sir, the economic situation of Pakistan cannot be sustained, by just increasing the taxes on those classes who are already, honestly paying taxes (particularly the salaried and middle income group) or constantly increasing POL, electricity and gas charges etc. The gravity of the economic misery can be easily gauged from the ever increasing suicide incidences in Pakistan. Now, the time has come, when business as usual cannot be run, any further.
 
Sir, even a correct decision is wrong, if it is taken too late. To say that Pakistan is under an economic emergency is an understatement. People are being deprived of basic necessities of life in the shape of food, shelter, energy, medicines, education and law and order. Firstly, in the name of market economy, the government privatized banks, sugar, edible oil, cement, fertilizer, automobile industries at throw away prices and secondly, now when prices of commodities of these sectors are increased indiscriminately, government machinery dare not check the lawlessness of these businessmen. Every other day prices of milk, sugar and other edibles are increased, without any intervention from the government in favour of the teeming millions.  Killings and abductions for ransom is order of the day, in many parts of the country. The loot and plunder of the nation by the mighty, has reached such a proportion, that people are openly saying that 5% rich are ruling the 95% poor of the country. 

 

Sir, corruption is the biggest danger to the survial of Pakistan. 

 

Sir, there is a saying of Hazrat Ali RA, that a system of ‘Kufr’ can sustain but not a system of ‘Zulm’. And in my opinion, the biggest Zulm with the poor after injustice is corruption. In fact, injustice stems from corruption. The monumental increase in corruption has tremendously increased poverty which in turn is now breeding terrorism. 

 
As such, you are kindly requested to please come on the corruption with a heavy hand and with more speed, lest the time slips from our hand.
 
As a first mega step, the government may be directed to approach the UN Security Council to pass an immediate resolution, directing all foreign governments to immediately help Pakistan (who is fighting the terrorism for the world as a frontline state), by returning entire illgotten  money back to Pakistan held by Pakistani nationals/dual Pakistani nationality persons,  in their banks. Sir, if successful, this will help Pakistan run its economy, without imposition of any taxes for many years.
